These Terms of Service ("Terms", "Terms of Service") govern your access to and use of the Bespoke Carat website, including our online store, products, services, content, features and tools (collectively, the "Services").

The Services are operated by Bespoke Carat Creation LLP, doing business as "Bespoke Carat" ("Bespoke Carat", "we", "us", or "our").

Bespoke Carat is an India-based jewelry and diamond business offering lab-grown diamonds, diamond jewelry, custom and made-to-order jewelry, and related services to customers internationally.

Our store is powered by Shopify, which provides the technology and infrastructure that enables us to offer our Services. However, purchases made through our website are transactions directly between you and Bespoke Carat.

By accessing or using our website, placing an order, or otherwise using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, please do not access or use our Services.

We make reasonable efforts to accurately display and describe our products, including diamonds, jewelry, materials, dimensions, colors, weights and other specifications.

However, actual product appearance may vary depending on your device, display settings, photography, lighting conditions and other factors.

Natural and lab-grown diamonds may exhibit normal variations in appearance, faceting, color, clarity, measurements and optical characteristics.

Product images, CAD designs, computer-generated renderings and photographs are intended to provide a visual representation of the product and may not always represent the exact final appearance of a finished piece.

For custom and made-to-order products, minor variations in measurements, proportions, finishing, color, setting and craftsmanship may occur within reasonable manufacturing tolerances.

Unless specifically stated otherwise, product descriptions, specifications, prices and availability may be changed or updated at any time.

We reserve the right to discontinue products or limit quantities available for purchase.

SECTION 3 - CUSTOM AND MADE-TO-ORDER PRODUCTS

Certain products offered by Bespoke Carat may be custom-made or produced specifically according to customer specifications.

Custom orders may include, without limitation:

  • Custom diamond shapes or dimensions

  • Custom diamond cuts

  • Custom jewelry designs

  • Custom CAD designs

  • Custom metal types or colors

  • Custom ring, pendant, bracelet or earring specifications

  • Special stone sizes or combinations

  • Customer-supplied designs or specifications

Before production begins, customers may be required to approve specifications, CAD designs, measurements, stone details or other production information.

Once production of a custom or made-to-order product has started, cancellation, modification or return may not be possible except where required by applicable law or expressly agreed by Bespoke Carat.

Any special terms applicable to a custom order will be communicated to the customer before or during the order process.

SECTION 4 - ORDERS AND ORDER ACCEPTANCE

When you place an order through our website, you are making an offer to purchase the selected products.

Receipt of an order confirmation does not necessarily mean that your order has been accepted.

We reserve the right to accept, reject, limit or cancel any order for reasons including, but not limited to:

  • Product availability

  • Pricing or listing errors

  • Payment issues

  • Suspected fraud

  • Incorrect customer information

  • Shipping restrictions

  • Customs or regulatory restrictions

  • Manufacturing limitations

Bespoke Carat may ship products internationally.

Unless expressly stated otherwise, these charges are the responsibility of the customer.

Customs authorities may inspect, delay or hold shipments. Bespoke Carat is not responsible for delays caused by customs authorities, import regulations, incomplete documentation, incorrect information supplied by the customer, or other matters outside our reasonable control.

Customers are responsible for providing accurate shipping information, including postal codes, phone numbers and any information reasonably required for customs clearance.

SECTION 7 - SHIPPING AND DELIVERY

We make reasonable efforts to process and ship orders within the estimated timeframes stated on the website or communicated to the customer.

Estimated production and delivery times are not guaranteed unless expressly agreed otherwise in writing.

Delivery times may be affected by:

SECTION 9 - DIAMOND CERTIFICATION

Where a product is advertised as certified, the applicable certification details will be specified in the product listing or order documentation.

Certification may be provided by an independent gemological laboratory such as IGI or another laboratory specified for the particular order.

Certification availability, fees and turnaround times may vary depending on the diamond and the customer's requirements.

Where certification is not specifically included in a product listing or order, the product may be supplied without an independent laboratory certificate.

SECTION 10 - PRODUCT INFORMATION AND MEASUREMENTS

Diamond and jewelry measurements may be stated as approximate where indicated.

Carat weight, dimensions, proportions and other specifications may vary within reasonable manufacturing and grading tolerances.

For custom products, final dimensions and specifications may differ slightly from initial estimates or CAD renderings.

Where a certificate is provided, the certificate issued by the relevant independent gemological laboratory will be the authoritative source for the specifications stated on that certificate.

All content on our website, including but not limited to:

is owned by Bespoke Carat, its affiliates, licensors or other respective owners and is protected by applicable intellectual property laws.

You may access and use our website for personal or legitimate business purposes related to purchasing or evaluating our products.

You may not reproduce, copy, distribute, modify, publish, sell, license, scrape, download or commercially exploit our content without our prior written permission.

Bespoke Carat, its logos, product names, designs and related branding may constitute trademarks or other intellectual property of Bespoke Carat or its licensors.

SECTION 12 - CUSTOMER-SUPPLIED CONTENT AND DESIGNS

If you provide us with photographs, artwork, CAD files, jewelry designs, specifications, drawings, measurements or other materials for the purpose of producing a product, you represent that you have the necessary rights and permissions to use and provide those materials.

You grant Bespoke Carat permission to use such materials solely as reasonably necessary to evaluate, design, manufacture, communicate about, and fulfill your order.

We will not knowingly use customer-supplied confidential designs for unrelated commercial purposes without appropriate authorization.

SECTION 13 - THIRD-PARTY SERVICES AND LINKS

Our website may contain links to or integrations with third-party websites, applications, payment providers, shipping companies, social media platforms or other services.

We do not control third-party services and are not responsible for their content, availability, policies, security, products or services.

Your use of third-party services is subject to the applicable third party's terms and privacy policies.

SECTION 14 - SHOPIFY

Our store is hosted and powered by Shopify.

Shopify provides the technology and infrastructure that enables us to operate our online store. However, purchases made through our website are made directly between you and Bespoke Carat.

Shopify is not responsible for the products we sell, the fulfillment of our orders, our refunds, our jewelry, our diamonds, or disputes arising directly between Bespoke Carat and our customers.
